RESOLUTION CONCERNING THE ESTABLISHMENT OF THE LANDSCAPING COMMITTEE

WHEREAS, Section 55.1-1819 Adoption and enforcement of rules of the Property Owners Association Act of Virginia states: “A. The board of directors shall have the power to establish, adopt, and enforce rules and regulations with respect to use of the common areas and with respect to such other areas of responsibility assigned to the association by the declaration, except where expressly reserved by the declaration to the members. Rules and regulations may be adopted by resolution and shall be reasonably published or distributed throughout the development….” and;

WHEREAS, Article III, BOARD OF DIRECTORS, Section 4: Powers and Duties of the Board, Item a. of the Church Point HOA Bylaws states: “Make provision for all expenses and adopt rules concerning the operation, care, upkeep, and maintenance of the Park Area, including any areas which may not be owned by the Corporation but which may be subject to common use, as well as other areas within Church Point which would serve the general benefit of the community.” and;

WHEREAS, Article III, BOARD OF DIRECTORS, Section 4: Powers and Duties of the Board, Item f. of the Church Point HOA Bylaws states: “Adoption of rules and regulations relating to Park use or other areas for the general benefit of the Corporation and community.” and;

WHEREAS, Article III, BOARD OF DIRECTORS, Section 4: Powers and Duties of the Board, Item g. of the Church Point HOA Bylaws states: “To hire or contract with persons for maintenance of the Park area or other areas for the general benefit of the community.” and;

WHEREAS, Article III, BOARD OF DIRECTORS, Section 4: Powers and Duties of the Board, Item h. of the Church Point HOA Bylaws states: “To appoint committees from time to time from the membership relating to community affairs.” and;

WHEREAS, there is a need to assist the Board of Directors in performing said duties.

Now, THEREFORE, BE IT RESOLVED THAT the Board of Directors establish the Landscaping Committee as its arm to conduct work related to the Common Areas.

  1. The Committee shall consist of any homeowner willing to participate.
  2. The Committee Chair and the Members of the Committee shall be appointed by the Board of Directors to serve at the pleasure of the Board.
  3. The Committee shall develop proposals to improve landscaping relevant parts of the Governing Documents and Rules and Regulations.
  4. The Committee shall review all contracts submitted to the association dealing with landscaping or lawn maintenance and make recommendations to the Board of Directors.
  5. The Committee shall develop a program for beautification of the Church Point Homeowners Association Common Areas and submit recommendations along with a recommended budget to the Board of Directors by August 1st of each calendar year.
  6. The Committee shall inspect the Common Areas to ensure that contractors are complying with the contract requirements. Any violations shall be reported to the Board of Directors.
  7. The Committee shall plan and oversee the planting of annuals at the entrance and in the parks.
  8. The Committee shall plan and oversee seasonal decorations at the entrance and in the parks (e.g. Christmas).
  9. The Committee shall select a  “Landscape of the Month” award from March through November based on a rotation between The Mews, The Commons and Bishops Court and The Quays.
  10. The Committee shall contribute an article to the Communications Committee for inclusion in the quarterly newsletter.
